2. Subject of the service

DUBHCORE is a management software (SaaS) for managing tattoo and piercing studios: accounts/studios/locations/teams, client linking, requests, appointments, calendar, messaging, documents and signatures, quotes and deposits, statistics, calendar integrations. DUBHCORE does not perform tattoos or piercings and does not provide healthcare or professional services.

3. Recipients

The Service is aimed at professionals/businesses in the sector. Registration presupposes the capacity to act and ownership of the declared activity.

4. Registration, account, credentials

The user provides truthful and up-to-date data and safeguards their credentials. Registration requires the explicit acceptance of the Terms and the Privacy Policy. The user is responsible for the activities carried out through their account.

5. Studios, locations, teams, collaborators, roles

The owner may create studios/locations/teams, invite collaborators and assign roles/permissions. Access to data is isolated per studio and limited according to roles. The owner is responsible for the correct management of their staff's access.

6. Client linking, requests, appointments, chat, documents

The Studio manages client linking (code/QR/link), requests, appointments, messaging, documents and signatures (remote for adults, in the studio, and for minors the double signature minor + parent/guardian in the studio). The Studio is responsible for the correctness of the information entered.

7. Uploaded content and responsibility

User content remains owned by the respective users/Studios. The user warrants that they have the rights/consents necessary to upload it and to process it through the Service, and is liable for it. DUBHCORE does not exercise prior editorial control over User content.

8. Responsibility of the Studio/Professional

The Studio remains solely responsible for its activity, the treatments performed, health safety, the applicable professional and legal obligations, the correctness of the data entered and the relationship with its clients (including notices/consents towards them).

8-bis. Health data and consent (Art. 9 GDPR) — technical function of the platform

The platform provides a technical function for collecting the explicit consent to health data (Art. 9(2)(a) GDPR) in the Tattoo and Piercing flows. With respect to this function:

  • the Studio is Controller of the processing of the health data of its clients and is responsible for the correct configuration and correct use of the function, for identifying the basis under Art. 9 and for the notice/consent towards its clients;
  • DUBHCORE does not provide healthcare services and does not take medical decisions: it provides exclusively the software tool, acting as Processor under the DPA;
  • the privacy consent to health data is distinct from any consent/authorisation to the treatment and from the signatures;
  • the technical handling (prior collection of consent, minimisation, handling of minors with consent given in the studio by the guardian, withdrawal with effect for the future, restriction of access to authorised roles only) is described in the Privacy Policy (§4-bis), which constitutes the reference for the processing.

9. Subscriptions, free trial, payments (Stripe)

Available plans (current configuration):

  • START — €35/month — free trial 7 days
  • PRO — €72/month — free trial 7 days

Any temporary promotions/discounts are governed by the conditions shown at the time of purchase and do not constitute a permanent part of these Terms. Client deposits may be managed via Stripe Connect and other methods configured by the Studio (e.g. bank transfer, payment in the studio).

10. Renewal, cancellation, suspension

Unless otherwise indicated at the time of purchase, the subscription renews according to the chosen periodicity. The user may cancel the subscription according to the methods made available. DUBHCORE may suspend/limit the account in case of breach of the Terms, non-payment or unlawful use, within the limits of the law.

11. Permitted and prohibited use

It is prohibited to make unlawful use of the Service, to infringe the rights of others, to upload illegal content, to attempt unauthorised access, to circumvent security measures, to carry out unauthorised reverse engineering, or to make abusive automated use.

12. Intellectual property

The Service, the software, the trademarks and the content of DUBHCORE are protected and remain owned by DUBHCORE or its licensors. User content remains owned by users; the user grants DUBHCORE a limited licence for the sole purpose of providing the Service.

13. Privacy and data processing (DPA Art. 28)

The processing of data is described in the Privacy Policy. When DUBHCORE processes the data of the Studio's clients on behalf of the Studio, the DPA (Art. 28 GDPR) applies, which constitutes an integral part of the Terms.

14. Third-party services (Google Calendar, Apple Calendar)

The Service integrates: Google Calendar (OAuth authorisation, read-only import) and Apple Calendar (access on the user's device). The use of such services is also subject to the terms of the respective providers.

15. Availability, maintenance, security

DUBHCORE endeavours to ensure the availability of the Service but does not guarantee the absence of interruptions. Maintenance interventions may be carried out. Technical/organisational security measures are adopted (see Privacy Policy / DPA Annex B).

16. Termination, export and deletion of data

Upon termination, the user may request/perform the export of their data and the deletion of the account according to the available functions. Signed documents remain immutable as provided.

17. Limitation of liability

To the maximum extent permitted by law, DUBHCORE is not liable for indirect/consequential damages. No clause limits liability in cases where this is not permitted by mandatory rules (e.g. wilful misconduct, gross negligence, personal injury). DUBHCORE is not responsible for the treatments performed by the Studio nor for the Studio-client relationships.

18. Force majeure

DUBHCORE is not liable for failures due to events beyond its reasonable control.

19. Changes to the Service and the Terms

DUBHCORE may modify the Service and these Terms; substantial changes will be communicated by appropriate means and with reasonable notice. The version and date in force are indicated at the top.

20. Applicable law and jurisdiction

20.1 Applicable law. These Terms and the contractual relationship with DUBHCORE are governed by Italian law, subject to the mandatory non-derogable provisions applicable under the law of the European Union or national law, which remain unaffected.

20.2 Professional / B2B users. For disputes involving Studios, professionals, businesses or users acting for purposes connected with their professional or commercial activity, the Court of Bolzano has jurisdiction (place of DUBHCORE's registered office).

20.3 Consumers. Where the user legally qualifies as a consumer, the mandatory rules on jurisdiction and consumer protection applicable under Italian and European law remain unaffected; the jurisdiction clause under point 20.2 does not apply to consumers where this is not legally permitted.

20.4 Data protection. Nothing in these Terms limits the rights afforded to the user under the applicable data protection legislation, nor the possibility of contacting the competent supervisory authority or of lodging a complaint with it (in Italy: Garante per la protezione dei dati personali). Contractual jurisdiction does not affect these rights.

20.5 Severability and non-exclusivity. The jurisdiction clause under point 20.2 operates within the limits permitted by the applicable mandatory rules and is not intended to be exclusive in every jurisdiction where such rules provide otherwise (in particular for the protection of consumers, according to point 20.3). Should any single provision of these Terms be invalid or ineffective, the remaining provisions remain fully valid and effective.
